UNDERSTANDING CAUSES FOR DELAY CRITICAL TO SUCCESSFUL MEDIATION

Overview

The Third Storm Water Pump Station, located in Fort Bend County Texas, was designed to solve local flooding issues. The levee improvement project began when Flintco, the contractor, was hired by the project owner in 2019 to manage various aspects of the construction process including the purchase and installation of mechanical bar screens and electrical equipment, as well as the installation of stormwater pumps. The $32,000,000 project was completed in October 2021.

The supplier for the stormwater pumps and motors entered a separate contract with the project owner to procure and coordinate the delivery of materials to Flintco for installation. As a crucial component of the project, the delivery delay resulted in damages to Flintco. Peritia’s experts were called upon to complete a schedule analysis to evaluate and apportion the delays arising from the supplier’s performance and to quantify associated damages (direct, indirect, and extended general conditions).

Solution

Peritia identified and apportioned the delays caused by the supplier’s deferred pump deliveries along with any potential concurrent delays from Flintco. Peritia’s insights were then presented at mediation by our expert to communicate the findings and evidence, explain the technical aspects of the case, and answer questions posed. The case was settled during mediation.
